Terms of Service

1. Agreement to Terms

By accessing or using ParAI's mobile application and services ("Services"), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you may not use our Services.

2. Eligibility

You must be at least 18 years old to create an account and use our Services. By using ParAI, you represent that you are a parent, legal guardian, or authorized caregiver of any children whose information you enter into the app.

3. Medical Disclaimer

IMPORTANT: ParAI is not a substitute for professional medical advice, diagnosis, or treatment.

  • The AI-powered advice and insights are for informational purposes only
  • Always consult a qualified healthcare provider for medical concerns
  • In case of emergency, contact emergency services immediately
  • Our AI references medical guidelines (AAP, WHO, CDC) but cannot replace professional judgment
  • Never disregard professional medical advice because of information provided by ParAI

4. User Accounts

When you create an account:

  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized access
  • You may not share your account credentials with others
  • You are responsible for all activities under your account

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Enter false information about children or health data
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Use the Services to harm, abuse, or exploit children
  • Reverse engineer or attempt to extract our AI models
  • Use automated systems to access the Services without permission

6. Family Sharing

When you invite caregivers to access your child's data:

  • You are responsible for managing their access permissions
  • You can revoke access at any time
  • Invited users must also comply with these Terms
  • You remain the primary account holder responsible for the child's data

7. Intellectual Property

The Services, including all content, features, AI models, and functionality, are owned by ParAI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. User Content

You retain ownership of the data you enter into ParAI. By using our Services, you grant us a limited license to process your data solely for the purpose of providing the Services, including AI-powered features. We do not claim ownership of your personal data or child information.

9. AI Features and Third-Party Data Processing

Our AI chat feature is powered by Google Vertex AI, a third-party service operated by Google LLC. When you use the AI chat:

  • Your chat messages, child profile data (name, age), recent activity logs, and any attached photos are sent to Google Vertex AI to generate responses
  • You will be asked for explicit consent within the app before any data is shared with the AI service
  • Your data is not used by Google to train their AI models
  • You can withdraw consent at any time by discontinuing use of the AI chat feature

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ParAI is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy of AI-generated advice
  • We are not liable for any health decisions made based on our Services
  • Our total liability shall not exceed the amount you paid for the Services in the past 12 months
  • We are not liable for indirect, incidental, or consequential damages

11. Indemnification

You agree to indemnify and hold harmless ParAI and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

  • Your right to use the Services will immediately cease
  • You may request export of your data before termination
  • We may retain certain data as required by law

You may delete your account at any time through the app settings.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email at least 30 days before they take effect. Continued use of the Services after changes constitutes acceptance.
